1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Karun Koirala, trading as Hearthstone Builds ("we", "us", or "our"), concerning your access to and use of the https://hearthstonebuilds.co.uk website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the "Site") and the residential construction services provided.
By accessing the Site and engaging our services, you acknowledge that you have read, understood, and agree to be bound by all of these Terms. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND OUR SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.
2. Residential Construction Services
Hearthstone Builds provides bespoke residential construction services, including but not limited to:
- Garage Transformations
- Utility Room Improvements
- Internal Partition Construction
- Storage Room Upgrades
- Practical Space Conversions
Standalone Projects: All services are provided as standalone, one-time residential construction projects. We do not offer memberships, subscriptions, recurring billing arrangements, maintenance plans, or ongoing service contracts.
3. Project Planning and Proposals
A. Initial Consultation: Every project begins with an initial discussion to understand your requirements and property layout.
B. Property Review: A physical site visit or property review is required to assess room dimensions and structural feasibility before a formal proposal is issued.
C. Written Proposals: Following the review, we will provide a written proposal outlining the defined scope of work, technical specifications, materials, and total cost.
D. Acceptance: Work will only commence upon your written acceptance of the proposal and payment of any required deposit.
4. Quotations and Pricing
Quotations provided in our proposals are valid for a period of 30 days. We reserve the right to amend quotations if the scope of work changes following further discovery or if there are significant increases in material costs beyond our control.
5. Scheduling and Timelines
We will agree on a start date and estimated completion date with you. While we strive to meet all deadlines, construction timelines are subject to factors such as material availability, weather conditions, and unforeseen structural discoveries. We will communicate any significant delays promptly.
6. Customer Responsibilities
You agree to:
- Provide clear and safe access to the property during agreed working hours.
- Ensure that all necessary planning permissions, building control notifications, or homeowner association approvals have been obtained (unless explicitly included in our scope of work).
- Provide access to essential utilities (water, electricity) required for the construction phase.
- Clear the workspace of personal belongings and furniture as agreed in the proposal.
7. Materials and Construction
We use high-quality materials as specified in the project proposal. Any changes to materials requested by you after the proposal has been accepted may incur additional costs and affect the project timeline.
8. Project Completion and Review
Upon completion of the construction phase, Karun Koirala will conduct a formal completion review with you. Any minor "snagging" issues identified during this review will be rectified by us at no additional cost. Once the review is signed off, the project is considered complete.
9. Payment Terms
Payments are to be made via Stripe as outlined in your project proposal. Typically, this involves an initial payment to secure the schedule and materials, with the remaining balance due upon project completion or at agreed milestones.
No Recurring Billing: We do not store payment details for recurring use. Each project is a separate transaction.
10. Dispute Resolution
In the event of a dispute, both parties agree to attempt to resolve the matter through informal, good-faith negotiations. If a resolution cannot be reached, the dispute shall be referred to mediation before seeking legal remedy in the courts of England and Wales.
11. Limitation of Liability
To the maximum extent permitted by law, Hearthstone Builds shall not be liable for any indirect, incidental, special, or consequential damages. Our total liability for any claim arising out of or relating to a specific project shall not exceed the total amount paid for that project.
12. Governing Law
These Terms shall be governed by and defined following the laws of England and Wales. Karun Koirala and yourself irrevocably consent that the courts of England and Wales shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
13. Liability Limitations
We are not responsible for any pre-existing structural issues or defects in your property that are discovered during the construction phase. Any work required to rectify such issues will be treated as a separate variation to the contract and quoted accordingly.
